Every few months a buyer emails us mid-panic: the plush is made, the cartons are palletised, and their freight forwarder or retailer has just asked for "the test report" — a document nobody scoped, nobody paid for, and which now needs a lab, a sample, and three weeks that the launch date doesn't have.
Toy safety compliance is the least glamorous part of a custom plush project and the one that most reliably wrecks timelines. The rules themselves aren't actually complicated; they're just badly explained, scattered across three legal systems, and usually discussed only after the money is spent. This guide is the version I wish every buyer had before the first PO: what each standard actually covers, what it costs, when to test, and which design decisions quietly change the whole compliance picture.
The three standards that cover 90% of plush orders
Where your plush is solddetermines which standard applies — not where it's made, and not where your company is registered. Most B2B plush orders land in one or more of these three regimes:

EN71 — the European set
EN71 is a series, not a single test. For a plush toy, three parts do the heavy lifting:
- EN71-1 — mechanical and physical properties. Seam strength, tensile testing on limbs and eyes, and the small-parts rules. This is where most plush failures happen: an eye or nose that detaches under pull force is an instant fail.
- EN71-2 — flammability. Measures how fast the pile surface burns. Long-pile fabrics are the ones to watch here.
- EN71-3 — migration of certain elements. Heavy metals (lead, cadmium and others) that could migrate out of the material if a child mouths the toy. This is a chemistry test on the fabric, dye, stuffing and any plastic parts.
The CE mark itself is not something a lab grants you — it's a declaration you make, backed by a technical file and a Declaration of Conformity. The test reports are the evidence behind that declaration. See the European Commission's toy safety pages for the current legal framework.
CPSIA and ASTM F963 — the US pair
These two work together and confuse almost everyone. CPSIA is the law; ASTM F963 is the toy safety standard the law makes mandatory. You need both satisfied.
CPSIA applies to products designed or intended primarily for children 12 and under, and it brings some hard requirements:
- Lead limit: 100 ppm total lead content in accessible substrate material.
- Phthalates: 0.1% limit on the specified phthalates in plasticised components.
- Third-party testing at a CPSC-accepted laboratory — not an in-house lab, not the factory's own bench.
- A Children's Product Certificate (CPC) issued by the importer, listing each rule the product is certified to, the lab used, and the manufacturing date and location.
- Tracking labels, permanently affixed to the product and the packaging, so a batch can be traced.
ASTM F963 then adds the physical toy requirements: small parts, sharp points and edges, flammability, and more. The CPSC business guidance is the authoritative starting point, and ASTM publishes the standard itself.

Age grading is the decision that changes everything
Before a single test is booked, you have to answer one question: is this toy intended for children under 3?Nothing else in the compliance plan moves until that's settled, because the under-3 rules are dramatically stricter.
For 0–36 months, any component that can detach and fit inside the small-parts cylinder is a choking hazard and a fail. In plush terms that means:
- Embroidered eyes and noses instead of plastic ones. This is the single most common design change we make for under-3 grading.
- No loose accessories — no removable hats, glasses, clip-on props, or bead-filled pouches.
- No long cords or ribbons beyond the permitted length, because of strangulation risk.
- Stronger seam and attachment requirements, since the toy will be chewed and dragged rather than displayed.
Two honest realities. First, "3+" is not a loophole: if the toy's appearance, marketing and packaging clearly target toddlers, a regulator can grade it as under-3 regardless of the label you printed. Second, the choice is genuinely commercial — under-3 costs more per unit and constrains your design, but it opens the baby-gift and hospital channels that are often the most repeatable B2B volume.
What the lab actually tests on a plush toy
Buyers often picture one test on one finished toy. In practice a lab tests the toy and its component materials, because a plush is an assembly of a dozen different inputs:

Notice the pattern in that last column: most failures come from a component nobody listed on the bill of materials. Hang tags, printed labels, drawstrings and accessory parts are frequently sourced separately from the main fabric and are the usual suspects when a report comes back with an unexpected fail.
What testing costs and when to schedule it
Costs vary by lab, market and how many materials are in the design, so treat these as planning ranges rather than quotes — a single-fabric mascot and a six-fabric multi-material design are not the same job. As a rule of thumb, a full EN71-1/2/3 package on a straightforward plush design typically runs in the few-hundred-dollars range per design, and a US package covering CPSIA chemical requirements plus ASTM F963 is broadly comparable. Two things move that number more than anything else:
- Number of distinct materials. Chemical testing is per material, not per toy. Five fabrics and three trims means a lot more chemistry than one fabric and embroidered features.
- Number of colourways. Different dye lots can require separate chemical testing, which surprises buyers who assumed one report covers the whole family.
On timing, plan for roughly one to two weeks of lab turnaround from the moment the lab has physical samples in hand — plus courier time to get samples there. The sequencing that works:
- Confirm the destination market and age grade at quotation, before pattern-making.
- Test the approved pre-production sample, not a random early prototype — the report has to describe what you're actually shipping.
- Run testing in parallel with bulk material procurement, so lab time overlaps production prep instead of extending the schedule.
- Keep the reports with the shipping documents. Customs and retail compliance teams both ask for them, usually at inconvenient moments.
How to verify a test report is real
Forged certificates are common enough that verification should be routine, not an insult. The method takes about a day:
- Ask for the full report, not the certificate. A one-page certificate image proves nothing. The report runs to many pages and names the tested SKU, the sample photographs, the test dates and every individual result.
- Check the report describes your product. Wrong colourway, wrong dimensions or a sample photo that isn't your design means the report belongs to something else.
- Confirm the report number with the lab directly. Accredited labs such as SGS and Intertek will verify a report number on request. Email them — don't use a phone number printed on the certificate itself.
- Check the dates. A report from three years ago for a "similar" product does not cover your production run.
Other markets worth knowing about
If you distribute beyond the EU and US, two more regimes come up regularly. Canada regulates toys under its own Toys Regulations, with requirements that overlap but are not identical to the US set — Health Canada publishes the guidance. Australia and New Zealand work to the AS/NZS ISO 8124 series, with the ACCC's product safety service as the reference point.
In practice, a plush built and tested to EN71 and ASTM F963 is usually close to compliant elsewhere, but "close" is doing real work in that sentence. Confirm the specific requirements per destination before you ship rather than assuming reciprocity.
The buyer's pre-production checklist
Run through this before bulk production starts, not after:
- Destination markets listed, and the standard for each one named in writing.
- Age grade decided, and the design reviewed against that grade's constraints.
- Full bill of materials written down — including hang tags, labels, threads and accessories.
- Testing scope, who pays, and who holds the reports agreed in the PO.
- Lab turnaround built into the production schedule, not bolted on at the end.
- Labelling artwork checked: age warnings, tracking label, importer address, care symbols.
- A plan for re-testing when you reorder with any material or colour change.
